6. Are there Debt Relief Scams

Hi, I’m attorney Kevin Williams, and I’d like to talk to you about the ads you may have heard on the TV and radio about fixing your debt problems without filing for bankruptcy.

I’ve heard those same ads, too – the one that says there’s a special, new government program that reduces credit card debt is the one that intrigued me -- so, not too long ago, I called the “800” number and talked to a salesman. Yes, I mean to use the term “salesman” – he wasn’t a lawyer or any kind of professional, but he was quite a nice fellow.

After admitting there really was no government program – he blamed an over- aggressive marketing firm and said they’d have to look into changing the ads -- he told me about a program offered by his company where I would stop making monthly payments to my creditors and instead make them to his company. After I had built up a significant balance with his company, his company would offer that amount to my creditors to settle my accounts with a big slug of my cash.

My salesman said that his company had a great success rate and would only take a fee from me if they were successful. And, even after I told him I wasn’t interested, he kept calling – a little like a dunning call from a creditor, really.

Firms of this nature are being investigated by federal and state governments right now because their success rate is not good – and many of these firms are simply scams.

But, even if they’re the real deal and their program works, they involve, at best, a significant repayment of debts and won’t help with anything besides credit cards.

Bankrutpcy, is that is the right alternative for you, deals with all of your debts through a process overseen by the bankruptcy court. It can stop harassing phone calls, letters, repossessions, and foreclosures. And you may have to repay none of your debts. It’s the real deal and it’s something that people with overwhelming obligations should at least consider – just as you’re doing now.
